Licence Agreement

This Licence Agreement covers your use of the ConTess application. Buying ConTess buys you a licence to use the software. It does not transfer ownership of it.

1. The licence you get

Subject to payment and to this agreement, we grant you a non-exclusive, non-transferable, revocable licence to install and use ConTess for your own purposes, on the number of Macs your tier allows:

  • Personal: one Mac.
  • Household: up to three Macs in the same household.

“Household” means Macs belonging to people living at the same address. It is not a licence for a business, a fleet, or a team.

There is no limit on how many vehicles on your own Tesla account you use it with, and no ConTess account is created.

2. What the licence does not allow

You may not:

  • copy the software except as needed to install and back it up;
  • sell, rent, lend, sublicense or redistribute it, or share your licence key;
  • reverse engineer, decompile or disassemble it, except to the extent that applicable law expressly permits despite this restriction (including for interoperability);
  • remove or alter any notice of ownership within it;
  • use it to provide a service to third parties.

3. Ownership

The software, its source code and its design remain the property of its author. This agreement grants no rights to the source code.

ConTess includes third-party components under their own licences, including Tesla's command-signing proxy and the Electron runtime. Those terms continue to apply to those components.

4. Your responsibilities

You are responsible for your Tesla account and developer credentials, for the verification file you place on a web address you control, and for the security of the Mac the software runs on. The signing key it creates lives on that Mac. If you lose the machine, treat the key as compromised and generate a new one.

5. Vehicle safety

ConTess can unlock your car, open its boot and frunk, move its windows and start its climate control. You are responsible for the vehicle and for deciding whether a command is safe to send at that moment. Do not use it while driving. Do not rely on it in an emergency.

6. Dependence on Tesla

ConTess works by using Tesla's Fleet API with credentials you supply. We do not control that API and cannot guarantee its continued availability, behaviour or pricing. If Tesla changes or withdraws it, functionality may be reduced or stop. That is not a defect in the software, though it may entitle you to a remedy under consumer law depending on the circumstances.

7. Updates

Updates within the same major version are included. An update may change or remove functionality where a dependency outside our control requires it.

8. Warranty and liability

The software is provided as it is. To the extent permitted by law we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. Our aggregate liability is limited to the amount you paid for the licence.

Nothing here excludes liability that cannot lawfully be excluded, or your mandatory rights as a consumer, including the statutory conformity guarantee for digital content.

9. Ending the licence

The licence ends if you materially breach this agreement, or if you are refunded. On ending, stop using the software and remove it from your Macs.

10. Not affiliated with Tesla

ConTess is independent. It is not affiliated with, authorised by, endorsed by or sponsored by Tesla, Inc. Tesla's trademarks are used only to identify compatible vehicles.

11. Governing law

Romanian law governs this agreement. As a consumer you keep the protection of the mandatory rules of the country where you live.

This agreement is published in English, Romanian and Spanish. The English version is the authoritative one: where a translation differs from it, the English text applies.
