These terms govern your use of the contess.app website and your purchase of a ConTess licence. Your use of the software itself is governed by the Licence Agreement, and refunds by the Refund Policy. Together those three documents form the agreement between us.

1. What ConTess is

ConTess is a macOS application that reads data from, and sends commands to, your own Tesla vehicle using Tesla's Fleet API and Tesla's official command-signing proxy. It runs on your Mac. We operate no servers that your vehicle data passes through.

ConTess is an independent product. It is not affiliated with, authorised by, endorsed by or sponsored by Tesla, Inc.

2. What you need before it will work

ConTess is only useful if all of the following are true. Please check them before buying, because they are requirements rather than optional extras:

  • A Mac running macOS 14 or later on Apple silicon.
  • A Tesla vehicle supported by Tesla's Fleet API (Model S, 3, X or Y).
  • A free Tesla developer account, which you create yourself. ConTess runs on your own Tesla developer application, not a shared one.
  • A web address you control where a small verification file can be placed, because Tesla will not accept commands from an application whose public key it cannot read. Free hosting is sufficient.

We cannot control Tesla's API, Tesla's terms, or whether Tesla continues to make the Fleet API available on its current terms. If Tesla changes or withdraws access, some or all of the functionality may stop working. That risk is inherent to the product and is reflected in it being a one-time purchase rather than a subscription.

3. Price, payment and VAT

Prices are shown on the pricing page and are exclusive of VAT unless stated otherwise. Payment is handled by Paddle, which acts as merchant of record: Paddle is the seller of record for the transaction, issues your invoice, and calculates and adds VAT according to your location. Payment is due in full before the licence is issued.

A ConTess licence is a one-time purchase. There is no subscription and no recurring charge.

4. Delivery

After payment you receive a licence key and a download link by email at the address given at checkout. Delivery is electronic and immediate. If either does not arrive, email us and we will resend them.

5. Your right to withdraw, and how it interacts with immediate delivery

As a consumer in the EU you normally have 14 days to withdraw from a distance contract. For digital content supplied immediately, that right is lost once supply begins if you have expressly consented to immediate supply and acknowledged that you thereby lose the right of withdrawal. That consent is requested at checkout.

Independently of that, we offer a voluntary 30-day refund, which is more generous than the statutory minimum and is not affected by the paragraph above.

6. Support and updates

Support is provided by email on a best-effort basis by the person who builds the software. Updates within the same major version are included at no cost. We do not promise a particular release schedule, and we do not promise that a future major version will be free.

7. Acceptable use of this website

You may not attempt to disrupt the website, scrape it at a volume that degrades it for others, or copy its content or design for reuse. The website's content is proprietary.

8. Liability

ConTess sends commands to a motor vehicle. You remain responsible for the vehicle at all times and for judging whether a command is safe to send. Do not rely on ConTess for anything safety-critical, and do not use it while driving.

To the fullest extent permitted by law, our total liability arising out of or in connection with the software or these terms is limited to the amount you paid for your licence. We are not liable for indirect or consequential loss, loss of data, or loss arising from your vehicle, Tesla's services or your chosen hosting being unavailable.

Nothing in these terms limits liability that cannot lawfully be limited, including liability for death or personal injury caused by negligence, for fraud, or your mandatory rights as a consumer under Romanian and EU law.

9. Changes to these terms

We may update these terms for future purchases. The version in force when you bought your licence is the version that governs it. Material changes will be reflected in the “last updated” date above.

10. Governing law

These terms are governed by Romanian law. If you are a consumer, you may also rely on the mandatory consumer-protection rules of the country where you live, and you may bring proceedings in the courts there.

These documents are published in English, Romanian and Spanish. The English version is the authoritative one: where a translation differs from it, the English text applies. That is true of these terms, the Licence Agreement, the Refund Policy and the Privacy Policy alike.
